General Terms and Conditions (GTC):

1. The following conditions are exclusively authoritative for all incoming orders. We will not accept terms and conditions (such as buyer´s conditions) otherwise provided unless we have explicitly confirmed them in writing. By placing an order, a client automatically acknowledges these delivery and payment conditions (General Terms and Conditions) of Polystone Chemical GmbH.
2. Orders will only count as accept if they are confirmed by Polystone Chemical GmbH in written form.

3. All former prices shall become invalid with the issue of this catalogue. We reserve the right to make changes concerning quantities and prices. We do not take adhesion for possible mistakes in this catalogue.

4. All prices are net price plus Value Added Taxes applicable on the date of delivery, ex works Blieskastel. Goods are delivered by UPS, GLS or Dachser, unless otherwise agreed in writing. Transport costs and fees charged for C.O.D. (cash on delivery) shall be borne by the customer.

5. The minimum order amount is EUR 500,- net value. If the minimum order amount should not be reached, there will be an extra charge for small quantities of EUR 100, - net value. Minimum order quantity: 24 pieces for filled up products in jars, 48 pieces for filled up products in bottles. Polystone Chemical GmbH, short of there is no other written agreement, cannot accept orders, which will not reach the minimum order quantity.

6. We expressively reserve the right to medicate products (articles) regarding design or colour, as well as technical improvements or technical modifications.

7. In general, payment will be effected in advance. The following methods of payment are possible: C.O.D. (cash), prepayment, direct debit or per credit cards from one of the below mentioned providers: VISA, EURO/MASTERCARD. For payment by credit card we require your credit card number, the expiration date of the card and the digit verification code of the credit card. Submitting the form, which is sent by us and accepted by the bank, is indispensable for direct debiting from your giro account. We will start production after receipt of payment. If we don’t receive your prepayment within 30 days after receipt of proforma invoice, the order can’t be considered in production planning and will be cancelled.

8. Goods delivered shall remain Polystone Chemical GmbH property until complete payment.

9. For delays in payment we calculate EUR 10,- administrative charges.

10. Objections and notices of defects can only be considered if these are announced in writing within eight days to us.

11. For justified objections, conversion or credit note can be required, resulting freight charges will be taken over by us. Further requirements are eliminated.

12. Transport damages have to be announced immediately to UPS, GLS or Dachser (driver on-site).

13. Delivery period delays, which occur through no fault of ours, such as higher force (act of nature beyond control) or strike claims for damages are excluded.

14. We cannot be held liable for damages arising out of the inappropriate use of our products. Recommendations for use are non-binding.

15. During exhibitions or special sales, delivery or payment conditions can deviate from the GTC.

16. Place of jurisdiction for both parties shall be Blieskastel. This also applies for non-merchants.

17. If our terms and conditions contradicting in whole or in part with the terms and conditions of our contractors, the terms and conditions of Polystone Chemical GmbH apply exclusively until a different agreement in writing will be accepted between the partners.
